Action Alert: Stop OPM From Silencing Federal Employees

Lawyers Defending American Democracy is issuing an Action Alert in response to a proposed rule released by the U.S. Office of Personnel Management. This proposal could result in all federal employees being required to sign a ​Nondisclosure Agreement that would impede government accountability and expose federal employees to civil and criminal penalties.

The proposal is an unlawful infringement on free speech, and its overbroad form could be enforced to preclude federal employees from taking actions that are expressly authorized or required by law.

As LDAD's Action Alert and accompanying Briefing Materials explain, the proposed NDA serves no legitimate governmental interest. Rather, it will shield the federal government from accountability and, by requiring such an NDA to remain in effect for five years after a federal employee leaves federal service, will have the effect of suppressing factual reporting of the history of this administration's actions that the public has a right to know.
