In its immediate rejection of the filing, The Florida Bar argued that it does not investigate ethics complaints against constitutional officers while they are serving. LDAD volunteer, James W. Conrad Jr., a principal author of the brief, noted that, if The Florida Bar's position were upheld, the effect "would be a statement to the legal profession that the Attorney General of the United States is above the law and need not comply with the same code of ethics that all other lawyers must follow."
